Following a recent, thorough valuation of your property, we are pleased to inform you that you may be eligible for a reduction in your property tax obligations. The Contingency Fee Agreement set forth below defines the scope of services, compensation structure, and authorization under which we may represent you in connection with the review, filing, and prosecution of any property tax assessment appeal or related proceedings before the appropriate municipal or governmental authorities.
CONTINGENCY FEE AGREEMENT
This Contingency Fee Agreement is entered into between The Ibive Group and the undersigned property owner _____.
1. Scope of Services
The Ibive Group is authorized to review the Client’s property tax assessment and, if appropriate, prepare, file, and prosecute an appeal or related proceedings before the applicable taxing authority.
2. Contingency Fee Arrangement and Filing Fees
All services are provided on a contingency-only basis. No fees are owed unless a reduction in assessed value and/or property taxes is achieved. There are no upfront, hourly, or retainer fees, except as otherwise stated herein.
If required by state or local law, Client is responsible for all mandatory application, filing, or government fees imposed by the taxing authority. Such fees must be paid in advance to The Ibive Group and are separate from and not contingent upon the contingency fee and are non-refundable regardless of outcome.
3. Fee Percentage and Applicable Tax Years
The Ibive Group shall receive (***)% of the actual tax savings realized as a direct result of its services.
4. Definition of Tax Savings
“Tax Savings” means the difference between the property tax liability or assessed value originally imposed and the final assessed value or tax liability as approved by the taxing authority due to The Ibive Group’s efforts.
5. Refunds and Distribution of Savings
Any refund or tax savings due to Client, after payment of The Ibive Group’s contingency fee, shall be remitted to Client within 30 days of The Ibive Group’s receipt of documented notice of such savings.
6. Expenses
The Ibive Group shall bear all ordinary administrative expenses. Any extraordinary third-party costs (including, but not limited to, appraisals or expert reports) shall require Client’s prior written approval.
7. Authorization
Client hereby authorizes The Ibive Group to act on Client’s behalf in matters related to the property tax assessment appeal, including communication with taxing authorities, subject to applicable law.
